What is the Duration of an Insurance Policy

.

All Policies expire at the end of each financial year (30th June each year).

.

Beyond this each registered Production is covered for the days proposed for in the Production Registration form only. If the dates of production change please inform ACTSIA immediately.

.

The Public Liability Policy is only active if your ACTSIA Membership fees are paid in full and your production is registered with ACTSIA.

.

When does my Policy Cover Commence?

.

Your Policy commences with receiving your Certificate of Currency from the insurer.

.

What are the Geographical Limits?

.

Coverage is in connection to activity conducted anywhere in Australia and New Zealand. However, worldwide coverage is available on a case by case basis. A small extra premium charge would also be required if this extension is requested.

What are the Key Features of Cover?

.

This policy will indemnify you against (a) legal liability to pay Compensation (b) Costs and Expenses in respect of accidental:

  • Third party Personal Injury
  • Third party Damage to Property

The limit of indemnity is $20,000,000 for any one claim. Under the policy the excess for third-party property damage is $1000.

What does the PLI Policy NOT Cover

.

You should always read the exclusions that apply to your insurance policy, for instance acts of terrorism are not usually covered. A list of some of exclusions found in this policy can be viewed below:

.

1) Personal Injury to any Employee (including Freelance and self-employed persons under your control)

2) Claims arising from asbestos

3) Defamation

4) Fines and Penalties

5) Internet Liabilities

6) Costs of repair, recall or replacement of defective products or works

7) Pollution or contamination unless sudden, unintended or unexpected

8) Professional Liabilities

9) Ownership or use of any aircraft or watercraft exceeding 10 meters.

10) Ownership or use of any motor vehicle where compulsory insurance is required

11) Stunts or Hazardous Activities

12) Owned or hired equipment

What are my obligations as a Producer beyond obtaining PLI?

.

As the Producer you must maintain your premises, machinery, plant and equipment in a satisfactory state of repair. You must take all reasonable precautions to prevent injury or damage to any person. You must comply with all legal requirements and safety regulations and conduct the activity of the production in a lawful manner.

It is also important that Producers seeking PLI through ACTSIA acknowledge and respect the values of ACTSIA, our members and stakeholders.

What other Insurance Coverage should I have?

.

As a Producer you need to make sure you are covered for all potential financial liabilities in case something goes wrong on your set. You may also wish to consider purchasing insurance in the areas listed below. On a broader level your insurance package may also cover your film for:

Equipment

All risks of physical loss or damage to equipment including whilst in transit. Note that loss of equipment caused by theft from unattended vehicles or acts of fraud are usually excluded from your cover. Likewise damage to equipment caused by mechanical or electrical breakdown or general wear or tear is again not usually covered.

Footage

Damage or loss to negatives and/or videotapes.

Workers Compensation

To provide indemnity in respect of your legal liability to pay compensation for death, disease or bodily injury to employees arising out of and during the course of their employment.
